The Indiana Supreme Court on Thursday upheld a former principal’s conviction for failing to immediately report a student’s rape in a school bathroom.
Christopher Smith, former principal of Muncie Central High School, was convicted in 2012 of the misdemeanor charge after he waited four hours to tell the Indiana Department of Child Services that a student had been raped by another student in a school bathroom.
Smith challenged his conviction, arguing he’d been looking into the validity of the allegations before calling police and did not realize minor-on-minor rape constituted child abuse. He also claimed the law that required him to “immediately” report child abuse was vague.
